You have paid the amount owed or your legal proposal has been accepted. If you now want to avoid the debt collection remaining entered in the debt collection register (and thus remaining on the debt collection register extracts), you must request a declaration from the creditor stating that he or she is revoking the debt collection. This declaration must be sent to the competent debt collection office.
If the creditor does not agree to a revocation of the debt collection, you must wait five years after the debt has been paid off before you can apply to the debt collection office to have the debt collection revoked/deleted.
If you want to have a debt collection deleted before the expiry of this period, you must apply to the court responsible for the debt collection and prove that the debt never existed or that it was not enforceable when the order for payment was issued.
Debt collection request - How do I proceed?
The debt enforcement request is the first step taken by a creditor (person to whom a sum of money is owed) to initiate debt enforcement proceedings and recover the amount owed from the debtor (person owing the sum of money).
Order debt collection information
You can order an extract from the debt collection register or information on debt collection from the debt collection desk of the Federal Office of Justice: Fill out the form online, print it out and send it to the relevant debt collection office by post. A request for withdrawal can only be made by the creditor or his representative! A declaration of withdrawal signed by the debtor on his own authority is invalid and constitutes a criminal offence!
Please note that unbilled costs on the part of the debt collection office are always charged to the creditor!
